Simon Bale (deceased)

1st Proclamation:
October 27th 1730 John Bale attained age of 21 hence proclamation that John Bale would take the premises.

2nd Proclamation:
February 15th 1731

3rd: Proclamation January 11th 1732 following which Robert Meek, Bayliffe, given a precept to seize the lands into the hands of the Lord of the Manor.
April 19th 1705 Samuel Lewld [??] signed Letter of Attorney appointing Robert Gallard of Wymondham & John Lynes of Wymondham as his attorneys with instructions to surrender his premises to Simon Bale.

October 30th 1705:
The attorneys presented this Letter of Attorney in the presence of Samuel Martin, Martha Lewld [??], Susan Walter, William Martindale



October 30th 1705
Simon Bale surrendered into the hands of the Lord of the Manor to the Use of his last Will & Testament.

October 18th 1711: Simon Bale had died before this Court.

October 22nd 1712 Sarah Bale (widow) was admitted according to the will of Simon Bale (deceased) until John Bale reaches age of 21.

November 6th 1717 Sarah then wife of Samuel Stannard, relict of Simon Bale admitted until John Bale should reach age of 21


John Bale, son of Simon Bale to receive at age of 21
6½ acres in 2 pieces:
1) 6 acres inclosed between the lands late of Edmund Borman [?] of Norwich East;
a Way in the Haugh Field West;
abutts upon land of divers men North;
and a lane from Haugh Field to the South;
2) ½ acre in Haugh Field between John Walter North;
lands late of Robert Oakley South;
abutts upon a way leading towards Sheppards Gap East.

Rev. John Colman claimed rights to the 10½ acres to which John Bale had been admitted earlier in this same Court, as above.
Colman brought a writ against Robert Meek. [why??];
Colman had supporting pledges from
John Doe & Richard Roe1; Colman said that
“… Robert Meek hath not entry but after the Disseisin which […] unjustly and without judgement hath made to the aforesaid John Colman within Thirty Years … and saith that he was seized of the [premises] as of Fee and Right at the Will of the Lord … in time of peace”
Robert Meek “Calls to Warranty” John Bale;
John Bale Calls to Warranty Nicholas Turner .
Court adjourns.
Nicholas Turner does not return so Court decides in Colman’s favour; Nicholas Turner is adjudged “in Mercy”.
Bayliffe (John Monk, Gent) is asked to cause to be delivered the premises which he does to Colman.
Colman then surrenders the recovered premises to John Bale.
John Colman and Robert Meek confirm that they have no remaining claims on these premises.
John Bale takes out a mortgage with for £157 10s with John House of Norwich, Esquire.

Comments

The process of reclaiming property where there is a disagreement with the Court follows a standard fictional procedure.
