Instructions from Andrew Lane (deceased)
The Court Roll does not include a verbatim quotation from the will of Andrew Lane (deceased) dated March 15th 1825, but it does include the following paraphrase:
… the said Testator gave and devised unto Mary Lane his Wife, provided she continues his widow and did not cohabit with any other man,
All that his farm house wherein he then lived with the barn, stable, cowhouse and all other outhouses thereto belonging with about forty acres of land were the same more or less and were the same freehold or copyhold or any other kind of nature or tenure whatsoever, situate in Deopham aforesaid, she his said Wife keeping the said premises in good and tenantable repair;
And that after the decease of his said Wife, the said Testator directed the said farmhouse, lands and premises to be sold by his Executors but he did not by his Will devise the same to his said Executors or any other person except to his said wife in manner aforesaid;
And that the said Testator appointed John Lane and Franklin Lane his two sons Executors of his said Will;
And the said Mary Lane and John Lane (by their said Attorney) informeth the said Steward that the said Andrew Lane died on or about the August 24th 1845 … leaving the said John Lane his eldest son and heir at law and heir according to the custom of this Manor;
And that the said John Lane and Franklin Lane having renounced Probate of the said Will of the said Andrew Lane, Letters of Administration of his personal Estate and Effects with his said will annexed were granted to Daniel Alexander of Hingham aforesaid, Gentleman, by the Archdeaconry Court of Norfolk on June 25th last;
And thereupon the said Mary Lane and John Lane (by their said Attorney) desire to be admitted Tenants to the Lands and Tenements whereof the said Andrew Lane so died seized as aforesaid, that is to say,
– the said Mary Lane desires to be admitted Tenant thereto for her life, and
– the said John Lane desires to be admitted Tenant to the Reversion or Remainder expectant on the decease of the said Mary Lane …
