Extract from the will of John Smyth
The following extract from the will of John Smyth, dated January 14th 1633, has been copied in English into the Court Roll:-
In the name of God Amen.
I, John Smythe
Item, I give and bequeathe unto John Smyth my youngest sonne, after the decease of Frances my Wiffe, all my premises, landes and tenements, both freehould & coppihold with their appurtenances situate, lieing and being in Deepham aforesaide to hould to him and to his heires forever, uppon condicon that he the saide John my sonne, his heires or assignes, shall paid or cause to be paid unto Nicholas Smythe my Sonne Forty poundes of good and lawfull monie of England at or in my messuage or house in Deepham aforesaid in manner and forme following, that is:-
to paid within one yeare next after the decease of Frances my wyffe, five poundes and soe from thenceforth yearely, and every yeare then next following, Five poundes untill the saide Forty pounds be paid;
And if the said John my sonne, his heires or assignes shall make defaulte of payment of the said some of Forty pounds, or anie parte or parcell thereof in manner and forme contrary to the true intent and meanyng of this my laste will and testament,
Then I will that the foresaid Nicholas my sonne shall enter into my houses, landes or tenement with two acres of pasture grounds more or lesse inclosed called the tenement Davies lieing next and adioyning to my messuage or head tenement in Deepham aforesaid
To houlde to him the said Nicholas and to his heires for ever for and in … and consideracon of the said some of Forty pounds
