Introduction to Robert Ockley & John Smyth
This is a complex Court in so far as the transactions concerning Robert Ockley and John Smyth are concerned. There are two packages of land involved:
1) 2 acres in Haughfield
2) 3 acres abutting Pye Lane + 1 acre in The Breeds.
It was recorded that Robert Ockley made a conditional surrender, to Bartholomew Stone, of the 2 acres at an out-of-Court session on October 10th 1668 in order to raise a loan of £25 11s 6d.
This transaction should have been formalised at the following Court held on November 2nd 1668, but is was not brought to the Court.
The out-of-Court conditional surrender for the 2 acres was repeated on November 10th 1668 and then brought before this Court for enrolment in the Court records. The terms of the loan were unchanged.
However, John Smyth asserted that Robert Ockley had already paid Bartholomew Stone the £25 11s 6d. This meant that Bartholomew Stone did not need to be admitted as a tenant, and that therefore Robert Ockley was at liberty to surrender the 2 acres.
The final event in this saga recorded that Robert Ockley in another out-of-Court transaction surrendered the 2 acres to Robert Blomfield who was formally admitted as tenant at this Court.
The bailiff confirmed that John Smyth held the 3 acres + 1 acre by copy of Court Roll, and had done so since November 6th 1660.
