Description of Piece No 59
The following description of Piece no 59 is given in the Court Roll; there is no indication that there was any building on the plot at this time.
All that piece or parcel of Land lying in Deopham aforesaid called “Deopham Close” being the fourth allotment by the award of the Commissioners acting under an Act of Parliament for inclosing lands in Deopham aforesaid made to Mary Eldred and marked on the Map annexed to the said award No. 59 containing six acres and ten perches bounded
by Land thereby allotted to John Francis, North-west
By the Lower Hackford Road, North-east
By land thereby allotted to the Reverend John Howard and now belonging to the Reverend Charles Beauchamp Cooper, South-east, and
By Land thereby allotted to Thomas Kett and Thomas Beck as Trustees under the Will of John Bousell and now or late belonging to Philip Pitts and respectively South-west
Which said piece of land is now or was late in the occupation of Robert Capon or his assigns or howsoever otherwise the said piece of land is bounded, abuttalled, called, tenanted or distinguished and ought to be described.
Release from Annuities and Estates Tail
According to the Court Roll, the above sum of £215 was paid on or by the direction and to the account of the following in order to release the property from the estates tail and annuities imposed on the property by the will of John Boddenham:-
- Thomas Eldred and
- Sarah Eldred and
- William Henry Eldred lately residing at Macar in China and now temporarily residing in the said Hamlet of Heigham and
- Judith Eleanor Bushell, late of Prospect Place, Wandsworth Road in Surrey but now of Manchester in the County of Lancaster, wife of
- William Bushell late of Prospect Place, Wandsworth Road aforesaid but now of Wellington Crescent, Wellington, Port Nicholson, New Zealand, Gentleman.
The Court Roll refers to a covenant or covenants contained in an Indenture dated November 26th 1846 between:-
- James Winter, Gentleman;
- James Parsons
- John Green Winter
- Thomas Eldred
- Sarah Eldred
- William Henry Eldred
- Judith Eleanor Bushell
- John Mann
- John Turner Graver Browne of Morley, Esquire
- Edward Baxter of Deopham, Farmer.
The most significant part of the ten party Indenture referred to above was that, according to the Court Roll, it enabled John Mann to buy this property unencumbered …
… freed and discharged from the Estates tail of Thomas Eldred & Sarah Eldred & all other Estates tail created by John Boddenham’s Will and all remainders and reversions thereupon expectant or depending;
and also freed and discharged from an annuity or yearly sum of £20 bequeathed to Bodney John Dowe and his assigns during his life;
and also discharged from the payment of a legacy or sum of £400 bequeathed in this Will to any child or children or the issue of any such which the said Bodney John Dowe shall leave at his decease – the same annuity and legacy having been exclusively charge upon and made payable out of certain freehold and copyhold hereditaments respectively conveyed and surrendered according to the respective tenures thereof unto or to uses in favor of the said Edward Baxter his heirs and assigns in exoneration of all the other hereditaments by the said will charged with the payment of the said annuity and legacy,
And also freed and absolutely discharge of and from all other charges and incumbrances whatsoever save only and except an apportioned annual quit rent of twelve shillings and the customary fines, suits and services henceforth to be paid and performed to the Lords of this Manor in respect of the said hereditaments.
