Tenancy Agreement

An agreement made the Seventeenth day of May One Thousand Nine Hundred and Twenty Four Between
– Alfred Julian Pitts of 203, Springfield Road, Chelmsford in the County of Essex, gentleman,
– Robert Elliot Pitts of 196, Springfield Road aforesaid, Medical Practioner [sic] and
– Julian Alfred Reynolds Pitts of 2, Brasmar Avenue, Chelmsford aforesaid, Electrical Engineer
(hereinafter called the Landlords) of the one part and
– Arthur Long of Scoulton, Attleborough, in the County of Norfolk Farmer
(hereinafter called the Tenant) of the other part.
The Landlords hereby agree to let to the tenant who hereby agrees to hire of them All that messuage of farm house and premises with the barns, stables, out buildings, yards, garden, orchard and pieces of parcels of arable meadow and pasture lands belonging situate in Deopham, Wymondham, Norfolk with the appurtenances,
Except unto the landlords all timber and other trees upon the said premises, with liberty at all times to enter upon the said messuage and premises as well to view the state and usage thereof as also to top, lop, fell and carry away the said excepted timber and other trees and for all other reasonable purposes whatsoever.
The tenancy to be for one year from the Eleventh day of October 1924 (upon the understanding that the present tenant Frederick H Potter leaves on or before that date) to the 11th day of October 1925 and then from year to year until this agreement shall be determined by one party giving the other party one year’s notice in writing expiring on the eleventh of October in and year at the yearly rent of Sixty-five pounds (£65) payable half yearly on the sixth day of April and the Eleventh day of October in every year. The first half yearly payment to be made on the Sixth day of April 1925 and
the tenant hereby agrees as follows:-
– To pay all rates, taxes and assessments payable by the tenant in respect of the said premises;
– To reside in the said farm house and keep the garden belonging thereto in neat order and condition;
– And not to assign, underlet or part with the possession of the said premises or any part thereof, not to plough, break up or convert into tillage any part of the meadow or pasture land without the landlords’ consent in writing; To farm and cultivate the arable lands in a good and husbandlike manner and according to the custom of the country, and to leave the same at the end of the tenancy in good heart and condition;
– And shall allow the landlords or incoming tenant to sow clover and grass seeds in the last year of tenancy amongst the summer corn which shall in that year be sown on the land;
– The tenant shall from time to time at the proper season open, scour and cleanse all ditches and water courses and leave the same at the end of the tenancy.
If any rent hereby reserved shall remain unpaid for the space of twenty eight days after the time hereby appointed for payment thereof, whether the same shall have been legally demanded or not, or
– if there shall be any breach of this agreement or
– if the tenant shall become bankrupt or
– compound or
– make any arrangement with his creditors
then, and in any of the said cases, the landlords may reenter into and upon the said House, Lands and Premises or any part thereof in the name of the whole and the same have again repossess and enjoy as in his former estate.
