This Indenture made the tenth day of November in the ninth yeare of the raiyne of our most gracious Soveraign & Lord, William the third, by the grace of God of England, Scotland, France and Ireland, King, Defender of the Faith etc and in the yeare of our Lord One thousand, six hundred ninety and seaven
Betweene
– John Whitefoot the younger of the Citty of Norwich, Clerke, & Robert Paine of Billingford in the County of Norfolke Esqr, grandson and heire of Sir Joseph Paine, late of the Citty of Norwich, Knight, deceased, of the one parte and
– William Grigson of Morley in the County of Norfolke, Clerke, of the other parte
Witnesseth that the said John Whitefoot and Robert Paine for and in Consideration of the Summe of Fifteen hundred pounds of lawfull English money to them the said John Whitefoot in hand paid by the said William Grigson att and before the Sealeing and delivery of these presents, the receipt whereof he the said John Whitefoot doth by these presents confess and acknowledge, and thereof and of every parte thereof doth acquitt, exonerate and discharge the said William Grigson, his heires, Executors, Administrators and assignes, and of the Summe of tenn shillings to the said Robert Paine likewise paid by the said William Grigson, (the receipt whereof is hereby acknowledged) and for divers other good Considerations them thereunto especially moving
Have and each of them hath granted, bargained, sold, aliened, released and confirmed, And by these presents the said John Whitefoot and Robert Paine doe and each of them doth grant, bargain, sell, alien, release and confirm to the said William Grigson (… his actuall possession now thereof being by force and vertue of one Indenture of Bargaine and Sale to him thereof made bearing date the day before the date of these presents and of the Statute made for transferring Uses into possession) and to his Heires
All those the Mannor of Shadwells and Cockerells with their appurtenances in Morley, Morley St. Bottolph and Morly St. Peter and elsewhere in the said County of Norffolke with their and every of their appurtenances (Except the Advowson and right of patronage of the Rectory or Church of Morley St. Bottolph with the Chappel of Morley St. Peter thereunto annexed);
And alsoe all Messuages, houses, edifices, buildings, barnes, Stables, Dovehouses, Yards, gardens, Orchards, Lands, tenements, meadowes, pastures, woods, Underwoods, Fouldecourses, liberty of Fouldecourses and Feed for sheep, Commons, rents, reversions, services, waters, Tithings, Moores, Marshes, Courts Leete, Views of Frank Pledge, Courts Baron and all other Jurisdictions, privileges, profitts, Comodityes, Emoluments and hereditaments whatsoever with their appurtenances situate, lyeing and being in the Townes, Fields or Parishes of Morley, Morley St. Bottolph, Morley St. Peter, Hingham, Wiclewood, Great Ellingham, Attleburgh or Elsewhere in the said County of Norffolke to the said Mannors or either of them belonging or in any wise appertaineing or accepted, respected, taken, used, occupyed or Enjoyed as parte, parcel or member of the said Mannors or either of them (Excepting the advowson as is aforesaid)
And alsoe all that Capitall Messuage commonly called or knowne by the name of Morley Hall now in the Use or possession of Thomas Downes as Farmer and tennant to the said John Whitefoot with all the Edifices, buildings, Dovehouses, Yards, gardens, Orchards and appurtenances to the said Capitall Messuage belonging or appertaining or to or with the same used, occupied or enjoyed or thereunto or to any parte thereof belonging or appertaineing by the aforesaid Thomas Downes, his Assignes or Assignees Undertennant or Undertennants and which are or be scituate, lyeing and being in the Townes aforesaid or any of them;
And alsoe all those Lands and grounds by estimation six acres containing the Dovehouse yard, the new orchard, Greate and Little Dunhill, the nursery & yards and gardens and homestalls bounded by a way leadeing from Wymondham to Deepham, South, the Lands now or late of William Sedley Esqr, West, the lands of the said John Whitefoot, East, by Crabtree Close and the Bakeyard, North;
Also the said Close called the Bakeyard by estimation Four acres bounded by the grounds called Dunhills South, little Fields, West, Crabtree Close, East;
Alsoe all that Close by estimation Four acres north of the Former bounded by the Little Fields West, by a Close called Long Close North, by a close now or late called the new Laid Close, East, by the said Bakeyard and Crabtree closes South;
Alsoe all that Close by estimation twelve acres bow or late called by the name of ye new laid close lying more East of the last, bounded on the East upon a four acre Close of the said John Whitefoot and the Lands late of the said William Sedley and now of the said William Grigson, West, North and South, upon the Lands of the said John Whitefoot;
Alsoe all that Close by estimation two acres lying South of the Former called or known by by the name of Hoggyard, bounded on the west by the Barnes and Stables by the said new laid Close North (all parcel of the bargained premises by west more south and the Lands late of the said Sedley and now of the said William Grigson, East;
Alsoe the said Close called or known by the name of the tenn acre Close and containeth by estimation four acres together with one acre lying therein lately holden in Exchange of Edmond Boreman Esqr but now lately purchased by the said John Whitefoot, and the said Close is bounded on the west by the said new laid Close and on the north by the said Long Close;
Alsoe one acre and a halfe at the westerly end of Penns Close, bounded by the Land late of Essau Kett Clarke and now of William Sedley on the west and north and by the Lands of the said Essau Kett and Sampson Sabbarton and now of the said William Sedley east, and the said Penns Close, South;
Alsoe all that Close of Land and Pasture by estimation Four acres called or knowne by the name of Kettsyard, bounded by the lands now or late of the said William Sedley, East, and the Lands now or late of Thomas Fyson, West, and the said William Sedley and Thomas Fyson, North, and the way leading from Wymundham to Deepham commonly called Westmoore, South;
Alsoe all that peice of land by estimation one acre Commonly called or known by the name of Dunhills acre bounded by the Lands of the said John Whitefoot East, a Dragg Way there West, and by the Lands now or late of the said William Sedley on the north and south;
And alsoe all that peice of Land and Pasture by estimation one acre called or knowne by the name of Tilliflower acre bounded by the Lands now or late of the said William Sedley East and West; by the Lands of the said John Whitefoot south and on the north upon a three roods of the said John Whitefoot and in parte upon the Lands now of late of the said William Sedley;
Also all that peice of Land by estimation three roodes lying north of the Former bounded by the LAnds now or late of Bartholomew Stone west, the said William Sedley, East, and by the Lands of the said John Whitefoot north;
Alsoe all that peice of Land by estimation three acres and a halfe in two pieces: one lyeing cross the head of the other, bounded by the Lands now or late of the said William Sedley on every parte of the same two pieces;
Alsoe all that peice of Land by estimation one acre called or knowne by the name of Shorte acre bounded by the lands now of late of the said William Sedley East and West and by the Lands of the said John Whitefoot, north and south;
Alsoe all that peice of Land by estimation three acres bounded by the Lands now of Sir John Woodhouse [sic], Barronett, East, Bartholomew Stone, West, by the Lands of the said John Whitefoot and the said William Sedley South, and the Lands now of late of John Amyas, North;
Alsoe all that Close of Land and Pasture called or knowne by the name of Long Close by estimation twelve acres (excepting halfe an acre or thereabouts lying in the said Close belonging to the said William Sedley), the said Close is bounded by the Lands now of Sir John Woodhouse north, by the little Field and the Lands of the said John Whitefoot, West, and by greate Field, East;
Alsoe all that peice of Land by estimation Four acres commonly called or knowne by the name of Deepham foure acres bounded by the Lands or Close called or knowne by the name of Munks Close or Land on the South and North, and the Lands now of late of the said John Amyas west and on the way leading from Deepham Church to Westmore Common, East;
Alsoe those two severall Inclosures lyeing together and the one north to the other by estimation Eight acres, the one commonly called the Lower and the other the Upper Foure acres;
Alsoe all that peice of Land by estimation one acre being more east, bounded by the Land now or late of Robert Snell west, the said Sir John Woodhouse east and by the Lands now or late of Mathew Gould and Robert Swift north, and the Lands of the said John Whitefoot, South;
Alsoe all that peice of Land by estimation nine acres bounded by the Lands now of the said Sir John Woodhouse, West, the said Mathew Gould, East and South, Robert Smith on the North;
Alsoe all that Close being more East of the last, by estimation Foure acres bounded by the Lands now or late of the said William Sedley, West, Robert Underwood and the said William Sedley, East, and by the was leading from Morley St. Bottolph to Deepham, South, and by several lands abutting upon Pallow Way, North;
Alsoe all that peice of Land by estimation one acre lying in a place or Field called or knowne by the name of Royers Land, bounded by the Lands late of Adam Bale and now of Robert Wasters on the East and north, separated by the Land now or late of the said William Sedley, East, and the Land of the said John Whitefoot, South;
Alsoe all that peice of Land by estimation Five roods lying in Rogers Olland aforesaid, bounded by the Lands now or late or the said William Sedley east and west and by several mens lands north and the Lands of the said John Whitefoot, South;
Alsoe all that peice of Land by estimation Five acres lying in Rogers Olland aforesaid, bounded by the Lands now of late of the said William Sedley, East, west and north and the Lands of the said John Whitefoot, South;
Alsoe all that peice of Land by estimation one acre lying more south, and in Exchange for Glebe Lands in the Church Close bounded by the Lands now or late of John Pooley, East, by the Townes Meadowes South and the Lands of the said John Whitefoot, North;
Alsoe all that Close called or knowne by the name of Church Close, by estimation seaven acres (besides one acre of gleabe land which is excepted out of this present Sale and is held in exchange for the before mentioned acre) bounded by the Lands of the said John Whitefoot north, and the Lands now or late of the said William Sedley – east and west, and a common way leading from Morley St. Bottolph Church to Deepham, South;
Alsoe all that meadow ground by estimation seaven acres called or knowne by the name Carnes Meadow, bounded by the Lands now or late of the said William Sedley east, West and North, John Raven and the way leading to Westmore, South;
Alsoe all that meadow ground lying more West by estimation Eight acres called or knowne by the name of Brands meadow bounded by the lands now or late of the said William Sedley East and West, John Pooley north and south;
Alsoe all that meadow ground by estimation three acres called or knowne by the name of Rayle meadow being triangular bounded by the lane now or late called Francis Lane, South, by the said way leading from Morley Church to Deepham, North, and the lands now of late of Mathew Gould, West;
Alsoe all that Close by estimation seaven acres called or knowne by the name of Brocfolds, those bounded on the north by a way leading to Westmore by the Lands now or late of the said William South and West & the said Sedley and John Raven, East;
Alsoe all that peice of ground by estimation two acres called or known by the name of Francis Grove bounded by Westmore Comon South, by a dragway leadeing to Westmore, North and West, and the Lands now or late of the said William Sedley, East, which said Land is now in the possession of Owen Church as tennant to the said John Whitefoot;
Alsoe all that Close by estimation nine acres called or knowne by the name of Clamp, those bounded by the Lands now or late of of the said William Sedley east and North, by a Dragway on the South, and the lane now or late called Francis lane, West
All which premises excepting Francis Grove are lyeing in the Townes & Fields of Morley, Morley St. Buttolph and Morley St. Peter, some or one of them and now are in the Use and Occupation of the said Thomas Downes as tennant and farmer thereof to the said John Whitefoot or in the use or occupation of the Assignee or Assignees, Undertennant or Undertennants of the said Thomas Downes;
And alsoe all those parcells of Land and ground being in the possession of John Porter and now in the possession of Gilbert Pointon which intermixed with the Lands of William Sedley Esqr, formerly of John Sedley Esqr, for which Land and ground there is and have been yearely paid Fifty Shillings as the rent of the same to the said Thomas Downes and all other … tennants of the premises;
And alsoe all other Messuages, Lands, Tenements and hereditaments whatsoever of them the said John Whitefoot and Robert Paine or either of them scituate, lyeing and being in Morley and Deepham aforesaid or either of them, or in any other towne or townes to them or either of them neare or adjoyneing, in the Possession of the said Thomas Downes, his Assignes & Assignees, Undertennant or Undertennants and in the Possession of the said Owen Church;
And the Reversion and Reversions, Remainder and Remainder[s] and all the Estate, right, title, Interest, trust, Equity and benefit of redemption, claime and demand whatsoever of them the said John Whitefoot and Robert Paine or either of them of, in, out or into the premises and every parte thereof, Excepting the said Advowson and right of presentation as aforesaid;
And alsoe all the Courte Bookes, Courte Rolls, Evidences, Writeings, Deeds and Emunments relateing to the premisses every or any parte thereof now in the hands, power or custody of the said John Whitefoot or which he cann come by without suite in Law or Equity, Excepting the said Advowson and right of presentation as is aforesaid;
To have and to hold the said Mannor and Mannors, Messuages, Lands, tenements, hereditaments and before ment, mentioned or intended to be granted and released Premisses with their and every of their appurtenances to the said William Grigson, his heires and assignes;
To the only use and behoofe of the said William Grigson, his heires and assignes and to noe other use, intent or purpose whatsoever
And the said John Whitefoot doth for himselfe, his heires, Executors and Administrators covenant and grant to and with the said William Grigson, his heires and assignes in manner following (that is to say) that itt shall and may be lawful to and for the said Willliam Grigson and his heires from time to time and att all times from henceforth for ever quietly and peaceably to hold, possess and enjoy the said Mannor, Messuages, Lands, tenements, hereditaments and premises and every parte thereof cleare and Free and Freely, clearly and absolutely acquitted, exonerated and discharged of and from all and all manner of Former and other bargains, Sales, Gifts, grants, Feofments, devises, uses, Jointures, Intails, Estates, Dowers, rights, titles, rents or arrearages of rents, debts, duties, Judgements, Executions, recognizances, Statutes merchant or of the Staple, surrender, Forfeitures and incumbrances whatsoever had made, done or suffered by the said John Whitefoot or by the said Robert Paine (Except one of more Mortgages made of the premises with other lands for the payment of nine hundred pounds & Interest to John Goose of the Citty of Norwich, worsteadweaver;
And that notwithstanding Act, fact, matter or thing done or suffered as is aforesaid by the said John Whitefoot or the said Robert Paine they the said John Whitefoot and Robert Paine or one of them have good right, full power and Authority to bargain, sell, alien and convey the said Mannors and all and singular other the premises with their and every of their appurtenances to the said William Grigson, his heires and assignes according to the true intent and meaning of these presents, Except as before Excepted,
And that the said John Whitefoot, his heires and assignes and all and every other person and persons intrusted for him or which shall or may lawfully claim or derive any estate, right, title or Interest of in or to the premisses or any parte by from or under the said John Whitefoot or the said Robert Paine (other than the present tennants in respect of their Leases, the rent whereof which shall from henceforth grow due is from henceforth to be paid to the said William Grigson and his heires) shall and will during the space of seaven years att the reasonable requests, costs & charges in the Law of the said William Grigson his heires and assignes make and doe all and every such further Act and Acts, conveyances and assurances in the Law for the further better and absolute assureing and conveying the said Mannor or Mannors and premisses with their and every of their appurtenances unto the said William Grigson, his heires and assignes as by the said William Grigson, his heires and assignes or his or their Councell Learned in the Law shall be reasonably devised, advised and required soe as such Conveyance containe not other or further Covenants then according to the true intent and meaning of these presents and soe as such person or persons required to doe such Act or Acts be not compelled to travel further then [sic] tenn Miles his, her or their dwelling place of aboad for doeing thereof,
And that he the said John Whitefoot, his Executors & Administrators shall and will from time to time and att all times hereafter deliver, or cause to be delivered, to the said William Grigson, his heires & assignes, All Deeds, readings & evidences belonging to the premisses or any parte thereof which shall happen to come to his or their hands,
And that he the said Robert Paine doth for himselfe, his heires, Executors & Administrators Covenant & grant to & with the said William Grigson, his heires & assignes that it shall & may be lawful to & for the said William Grigson, his heires & assignes quietly and peceably to have, hold, possess and enjoy the said Mannor or Mannors, Messuages, Lands, tenements & hereditaments without any claim, disturbance, eviction or ejection of him the said Robert Paine, his Executors or Administrators or any other person lawfully claimeing or deriving any estate, right, title or Interest by, from or under him or them.
In witness whereof the said parties first above named have to these presents agreably putt their hands & Seales the day and years first above written.
