1910 Enfranchisement
This Indenture made this Seventeenth day of December One thousand nine hundred and ten
Between
– The Right Honourable John, Earl of Kimberley, Lord of the Manor of Deopham Hall, in the County of Norfolk and
– John Meek of Thorpe St. Matthew in the County of the City of Norwich, Retired Carpenter, of the other part,
Witnesseth that in consideration of the sum of Eight pounds two shillings and six pence upon the execution of these presents paid by the said John Meek to the said John, Earl of Kimberley, for the enfranchisement of the hereditaments hereinafter expressed to be hereby appointed (the receipt of which said sum the said John, Earl of Kimberley, doth hereby acknowledge) the said John, Earl of Kimberley, in exercise of the powers for that purpose reserved to or conferred upon him by an Indenture of Settlement dated the sixteenth day of June One thousand eight hundred and seventy and expressed to be made between
– John, First Earl of Kimberley, of the first part,
– the said John, Earl of Kimberley (party hereto) then and therein referred to as John Wodehouse (commonly called John Baron Wodehouse) the eldest Son and Heir apparent of the said First Earl, of the second part, and
– The Right Honourable Anthony Henley, Lord Henley, and Edmund Robert Wodehouse of the third part.
And by another Indenture of Settlement dated the fifteenth day of November, One thousand nine hundred and seven and expressed to be made between
– the said John, Earl of Kimberley (party hereto) of the first part;
– The Honourable John Wodehouse (commonly called John Lord Wodehouse) the Eldest Son and Heir Apparent of the said John, Earl of Kimberley (party hereto), of the second part;
– Lady Constance Wodehouse of the third part; and
– Laurence Currie and Edward Hussey Jacke of the fourth part.
And of every other power enabling him in this behalf, doth by this present Deed
Revoke all uses, trusts, powers and provisions which under the aforesaid Indentures of Settlement or either of them or in exercise of the powers of jointuring or charging portions therein contained are now subsisting, or capable of taking effect, in the freehold and inheritance of the hereditaments hereinafter expressed to be hereby appointed and enfranchised or in the reliefs, rents and services from which the same are hereinafter expressed to be enfranchised and released except the power hereby exercised and doth as beneficial owner by this present Deed Appoint that
All that piece of Copyhold land in Deopham in the County of Norfolk marked on the map annexed to the Award of the Commissioners for inclosing lands in Deopham aforesaid, No 2 containing Two roods and thirty perches bounded by land attached to Aaron Lane West and North, by land allotted to Richard Jolly in part East, and by land allotted to Robert Herring Esquire in part South, and on the remaining part of the East, and by the Wymondham Road or Palloway on the remaining part of the South. Which premises the said John Meek had and took up to him and his heirs at proceedings held for the said Manor on the Ninth day of December one thousand nine hundred and ten;
Together with all mines, minerals, ways, watercourses and rights and particularly the rights reserved by Section 23 of the Copyhold Act 1894 and all liberties and appurtenances to the said copyhold hereditaments of any part thereof belonging or enjoyed or reputed as part or member thereof or appurtenant thereto;And the freehold and inheritance of the said Copyhold premises
Shall henceforth go and remain unto and to the Use of the said John Meek, his heirs and assigns
Enfranchised from the Copyhold tenure thereof and from all rents, fines, heriots and services and other incidents of customary or copyhold tenure.
And it is hereby expressly agreed and declared that the covenants for title by the said John, Earl of Kimberley (party hereto) which by virtue of the Seventh Section of the Conveyancing and Law of Property Act 1881 are implied in this Deed shall by no means extend to the copyhold or customary estate or interest subsisting in the said premises at or immediately before the execution of these presents.
And further, that in respect of the remainder expectant on the life estates of the said John Earl of Kimberley (party hereto) in the premises is and the title to and further assurance of the premises after his death the said implied covenants of the said John, Earl of Kimberley (party hereto) shall not extend to the acts or defaults of any person or persons other than or besides himself and his own heirs and persons claiming through or in trust for him or them or any of them,
And the said John, Earl of Kimberley (party hereto) acknowledges the right of the said John Meek to the production and delivery of copies of the Indentures of the sixteenth day of June One thousand eight hundred and seventy and the fifteenth day of November One thousand nine hundred and seven respectively hereinbefore mentioned or referred to.
And it is hereby certified and declared that the transaction effected by these presents does not form part of a larger transaction or series of transactions in respect of which the amount or value or the aggregate amount or value of the consideration exceeds Five hundred pounds.
