This Indenture made the xiijth day of October in the xxxth yere of the reigne of Kyng Henry the eyght betwene the reverend father in God Thomas prior of Christchurche in Canterbury & the Convent of the same place of th’one partie, and Robert Kalley of Iykylborough and Robert Kalley hys sonne of the same in the Countie of Northfolke yeoman of th’other partie,
Witnesseth that the seid Priory and Convent have betaken1 & to ferme lett unto the foreseid Robert & Robert Kalley hys sonne the Manor of Deophm and the parsonage of the same being in the Countie aforeseid With all lands, tythes, profetts & emoluments to the same parsonage belongyng,
Except and alwayes reserved unto the foreseid Priory & Convent and to their successors all manner of tymber, Wodde & underwood, escheats and stray Felons goodes & all other thyngs that belongyth unto the Farmhouse,
To have, hold & occupy the foreseid Manor & Parsonage With the appurtenances to the foreseid Robert and Robert from the feast of Seynt Mychaell th’Archangell last past before the date hereof unto the ende & terme of xxxj yeres then next followyng & fully to be completed,
Yielding therefore yerely unto the seid Priory & Convent, or to their successors, xvj li of good and lawful money of England, to be paid in hand of every yere unto the Warden of the Manors for the tyme being or else to hys deputy att ther Manor in Hadlegh in the Countie of Suffolke
And they personally shall appear before the seid Warden & auditory or ther deputies and make a true and a full accompt & full declaration of the seid ferme & parsonage of all manner of reparations & arrerage & ther montynent[???]2 to be dyscharged.
And yf it happen the foreseid yerely summe of 16 li to be behynde unpayed in p’te or in all by the space of xv dayes aft’ the tyme of payment in the which it ought to be payed, that then it shalbe lawfull unto the seid Priory & Convent or theyr successours into the foreseid manor & parsonage with the appurtenaunces to reentre & then enjoy as in theyr fyrst estate, and the seid Robert & Robert Kalley theyr executors & assignes therof holy3 to put out & amove, thys Indenture to the contrarye not withstandyng.
And furthermore, it shall not be lawful unto the aforeseid Robert & Robert, theyr esecutors & assignes to grante & lett to ferme to any man or p’son or p’sons the aforeseid Manor & Parsonage nor no part thereof without especyall lycens of the seid priory & convent or theyr successors.
Also, it shall not be lawfull unto the foreseid Robert & Robert Kalley to fyll or cause to be fylled any man’ of tymber, wodde & budwodde growyng in & upon the aforeseid Manor & parsonage during ther seid time.
Also, the seid Robert & Robert Kalley al man’ of blade whych shall com of the seid manor & parsonage yerely during ther seid time in the barnes of the seid manor & parsonage and no where ells shall Inne;
And the dong of the same blade comyng yerely uppon the lands of the seid Manor & parsonage for compost shall lede, cary & put;
And all othere pasturyng uppon the seid manor & parsonage & no where ells shall put to fold;
And all the dong coming of the blade of the last yere of ther seid time within the seid manor & parsonage shal leve to the behoffe of the seid priory & convent & ther Successors.
Also, the foreseid Robert & Robert Kalley shall fynde unto the Steward of the seid priory & convent & as ofte as he doth come to hold & kepe the Corte then upon the seid manor & parsonage both manne meate & horse meate for hym & hys [???]4.
And the seid priory & convent covenantith for them & ther successors to pay unto the forseid Steward hys fee for the courte holden & kept uppon the aforeseid manor & parsonage of Deopham
And the rolle of the same to be engrossed in parchment yerely to be delyvyd unto the seid priory & convent or to ther successors at thonly cost & charge of the seid Robert & Robert Kalley;
Also the within named Robert & Robert shall fynde the Warden of the Manors of Crystchurch before rehersed or any other offycer or mynyster of the seid church that shall come for the accompte & paymente of the same Manor & Parsonage or ells to viewe & [???5] the seid Manor & Parsonage for hym & his [???]6 & ther horses by the space of ij nyghts & a day suffycyent horsemeate & mannysmeate & all other thyngs necessary yerely at ther p’per coste & charge duryng ther seid time.
Also, the seid Priory & Convent covenantith for them & ther successors to maynteyne & competently to repayre the seid Manor & Parsonage at ther coste & charge,
Except the seid buyldngs, walls & other closure of the seid Manor & Parsonage be damaged & hurted thorough & by neclygenc of the seid Robert & Robert Kalley ther beeste or [???]7 that then the seid Robert & Robert all such hurte them soo don shall emend & repayre at ther p’per coste & charge;
Also, the seid Priory & Convent & ther successors shall dyscharge the seid Robert & Robert Kalley of all charge of dymes & xvths due for the seid Manor & Parsonage at ther coste & charge.
Also the seid Robert & Robert Kalley covenantith for them & ther executors to make or cause to be made ij boks called terrars conteynyng & expressyng all the several lands & Glebelands belonging unto the forseid Manor & Parsonage of Deopham And ij Rentalls conteyning the names of all tennants as well Freeholders as copyholders what so ev’ they be holdyng of the seid Manor at tyme of dely’ng of the same rentalls;
And how moch & what lands & tent’s each of them by estymacyon then shall hold of the seid Priory & Convent as of ther Manor of Deopham aforeseid with the names of ev’y fold & crofte & the true nombrs of Acre with the true mete & bounde of the same whereby it may be knowen where such lands & ten’ts & any p’rcell therof lyeth and by what & howe moch fermes, rents & [???]8 they b’enholden & for what Sommys of money ev’y p’cell of the same ferme lands ys betaken or let to ferme, which boks & rentalls them so made shall ingrose in parchment at ther p’per cost & charge
And thes boks shall delyr or cause to be delyvrd unto the foreseid prior or to hys successors in the viith yere of ther seid time; one of each of the seid boks and th’other ij boks in the xxist yere of ther seid time uppon payne of forfature of thys present lease & Indenture.
Also, the foreseid Robert & Robert Kalley have receyvyd of the seid Priory & Convent for Store ij acre of Ote sesonably Inned in the barne there; in the hall a tabyll with trestylls; in the kechen a lede with a fleyth9, one goode bedstedyll & iiij locks with keys upon the dorys there, the which store the seid Robert & Robert Kalley or ther executors shall leve in thende of ther seid time in as goode case as it was when they recevyd itt.
Also, the seid Robert and Robert Kalley shall have the use of the barnes of the seid Manor & Parsonage from th’ende of ther seid time unto the feast of the Natyvitie of Seynt John Baptist then next followyng with fre goyng & comyng to & from the same.
And yf it happen the seid Robert Kalley and Robert hys Son to dye both before thende of ther seid time that then it shalbe lawful unto the foreseid Priory & Convent or ther Successors into the seid Manor & Parsonage of Deopham with th’appurtenncs to reentre at the feast of Seynt Mychaell thArchangell then next followyng & the same to enjoy as in ther fyrst estate, and the seid Robert & Robert, ther executors & assigns thereof, holy to put out & amove, thys Indenture to the contrary not withstanding.
And wher as John Thyrlbye & Thomas Stybname of Burston in the Countie of Northfolke, yomen, stande bounden to & with the forseid Robert & Robert Kalley by an oblygacyon unto the forseid prior in the sum of xl li. of goode & lawfull money of Ingland to be payed at the feast of Easter next followyng as in the same oblygacyon more plainly doth appere
The seid Priory grantith for hym & hys successors by thys present that yf the seid Robert & Robert Kalley, ther executors & assignes do well & truly content & pay to the forseid priory or hys successors the aforeseid yerely sum of xvj li. and also do kepe & p’forme all such Covenants & agrements as be in thys Indenture rehersed aft the forme & effect of the same, then the seid oblygacyon of xl li. to be of none effect or ells it to stande & abyde in hys full streynght & vertue.
Furthermore, yf it happen any of the foreseid Surerties as John Thyrebye & Thomas Stybname to dye within the seid time of xxxj yeres, then so ofte thatt the seid Robert & Robert Kalley or the longyst lyver of them cause another suffycyent p’son to be bounde unto the seid priory & convent & ther Successors in lyke sum of money, forme & condycyon as the seid p’son was in that so shall happ to decease and that within a qrt of a yere or ells when they shalbe reqyred of the seid prior or hys successors.
In wytnesse wherof as well the Seale of the seid Priory & Convent all causes as the seales of the seid Robert & Robert Kalley interchangeably byn setto the day & yere above wryttyn;
And that the seid fermours have hereby iij old rentals in parchment;
It: ij newe rentalls, th’one ys dated the vth yere of Kyng Henry the vijth and thother the xijth yere of the same Kyng;
It: a Confirmarcyon under the Kyngs Seale with a copy of the same in parchment;
It: a bagg with court rolls & other mynyments concernyng the same Manor.
