Manor of Deopham Hall Enfranchisement February 1923

Indenture of April 13th 1923
The full text

This Indenture made the thirteenth day of April One thousand nine hundred and twenty three
BETWEEN
– HELEN GERTRUDE PHOENIX of Deopham in the County of Norfolk, Spinster, of the one part and
– WALTER CHARLES PHOENIX of Deopham aforesaid, Farmer, of the other part
WHEREAS by an Indenture dated the twenty fourth day of November One thousand, nine hundred and twenty two and made between:
– Herbert Allen, Walter Charles Allen and Sarah Allen of the first part1,
– the said Walter Charles Phoenix of the second part and
– the said Helen Gertrude Phoenix of the third part,
the said Herbert Allen, Walter Charles Allen and Sarah Allen in consideration of the sum of One thousand one hundred and forty pounds to the said Herbert Allen, Walter Charles Allen and Sarah Allen, paid by the said Walter Charles Phoenix, (inter alia) bargained, sold and appointed the hereditaments hereinafter described and intended to be hereby conveyed which were then copyhold of the respective Manors of Deopham Hall and Deopham of the Dean and Chapter of Canterbury unto the said Helen Gertrude Phoenix and her heirs, In trust for the said Walter Charles Phoenix his heirs and assigns;
AND WHEREAS at Proceedings held for the said Manor of Deopham Hall on the second day of December One thousand, nine hundred and twenty two the said Helen Gertrude Phoenix was duly admitted tenant to the hereditaments hereinafter firstly described, To hold to her and her heirs In trust for the said Walter Charles Phoenix his heirs and assigns at the Will of the Lord and according to the custom of the said Manor by the rents, suits and services therefor due and of right accustomed
AND WHEREAS by an Indenture dated the second day of February One thousand nine hundred and twenty three and made between
– The Right Honourable John, Earl of Kimberley, Lord of the said Manor of Deopham Hall of the first part,
– the said Helen Gertrude Phoenix of the second part and
– the said Walter Charles Phoenix of the third part for the consideration therein mentioned the said hereditaments copyhold of the said Manor of Deopham Hall were appointed, enfranchised and released unto the said Helen Gertrude Phoenix her heirs and assigns, In trust nevertheless for the said Walter Charles Phoenix, His heirs and assigns enfranchised from the copyhold tenure thereof and from all rents, fines, heriots, suits and services and other incidents of customary or copyhold tenure including all rights reserved by Section 23 of the Copyhold Act 1894;
AND WHEREAS on the twenty sixth day of January, One thousand nine hundred and twenty three the said Helen Gertrude Phoenix was out of Court duly admitted tenant of the said Manor of Deopham of the Dean and Chapter of Canterbury to the hereditaments hereinafter secondly described and comprised in the second part of the said Schedule hereunder written, To hold to her and her heirs In trust for the said Walter Charles Phoenix, his heirs and assigns at the Will of the Lords and according to the custom of the said Manor by the rests and services therefore due and of right accustomed,
AND WHEREAS by an Indenture dated the twelfth day of April, One thousand nine hundred and twenty three and made between
– The Ecclesiastical Commissioners2 for England, Lords of the said Manor of Deopham of the Dean and Chapter of Canterbury of the one part and
– the said Helen Gertrude. Phoenix of the other part
for the consideration therein mentioned, the said hereditaments copyhold of the said Manor of Deopham of the Dean and Chapter of Canterbury were granted, enfranchised, released and conveyed unto the said Helen Gertrude Phoenix in fee simple, In trust for the said Walter Charles Phoenix his heirs and assigns as freehold thenceforth and for ever discharged from all fines, quit rents, heriots and other incidents of copyhold or customary tenure
AND WHEREAS the said Walter Charles Phoenix has requested the said Helen Gertrude Phoenix to convey the said hereditaments to him in manner hereinafter appearing,
NOW THIS INDENTURE WITNESSETH that in consideration of the premises and of the sum of Five shillings to the said Helen Gertrude Phoenix now paid by the said Walter Charles Phoenix (the receipt whereof is hereby acknowledged)
THE SAID Helen Gertrude Phoenix as Trustee doth hereby convey and release unto the said Walter Charles Phoenix and his heirs
FIRST ALL THAT piece of land by the Award of the Commissioners acting under the Deopham Inclosure Act allotted to George Brown Leak Knight (in the said Award called by his then name of George Brown Leak) as Trustee of John Brown Esquire and marked on the map or plan annexed to the said Award Number 180, containing Seven acres two roods thirty three perches with the messuage and other buildings standing thereon bounded by land allotted to William Locke, North, by land allotted to the said John Browne East and South and by the Ellingham Road East and West
SECONDLY ALL THAT piece of land by the Deopham Inclosure Award allotted to George Browne Leak Knight (in the said Award called by his then name of George Browne Leak) as Trustee of John Browne Esquire and marked on the map or plan annexed to the said Award Number 154, containing Eleven acres two roods and thirty nine perches bounded by the Parish of Hingham North West, by land allotted to Charles Allen North East, by the Ellingham Road South East and by the Parish of Great Ellingham South West;
AND ALSO ALL THAT piece of land by the said Award allotted to Abraham Skipper marked on the said map annexed to the said Award Number 157, containing one acre two roods twenty seven perches bounded by the Ellingham Road South East and by land allotted to the said John Browne on all other parts
AND ALSO ALL THAT piece of land by the said Award allotted to Charles Allen and marked on the said map annexed to the said Award Number 155, containing three roods six perches bounded by the Parish of Hingham North West, by land allotted to the said John Browne North East, by the Ellingham Road South East and by land allotted to the said George Browne Leak Knight (by his then name of George Brown Leak) South West
TO HOLD the same unto, and TO THE USE of, the said Walter Charles Phoenix in fee simple.
IN WITNESS whereof the said parties to these presents have hereunto set their hands and seals the day and year first before written.
